What to Do Following a Diagnosis: Blended Families

March 28 @ 2:00 pm - 3:00 pm

Following a major diagnosis such as dementia, it’s important for families to engage in legal planning that will save money and ensure continuous quality care for the person with the disease. This estate planning and long-term care planning process involves reflection and thought for every planner, but individuals who have blended families encounter specific challenges that other individuals may not experience. This presentation by Attorney Bailey Schiermeyer focuses on those specific challenges. The presentation will lay out the statutory defaults, and participants will learn about available planning options and planning pitfalls to avoid. Specific topics include:

  • What rights, privileges, and shares do married couples have under Tennessee law, and how do these statutory protections impact estate planning?
  • Prenuptial and Postnuptial agreements: useful multifaceted tools to ensure promises are kept and promote family harmony.
  • The additional complexities blended families encounter when designing estate plans.
  • Medicaid and VA benefits: discussion about benefits programs and certain components of these programs that can cause problems for applicants in second marriages.
